Acceptable Use Policy
This Acceptable Use Policy (the “AUP”) governs how you may use SenderKit and is incorporated into the Terms of Service. Capitalized terms not defined here have the meaning given in the Terms. SenderKit is operated by Neurabyte LLC(dba SenderKit). We may update this AUP from time to time; the “Last updated” date reflects the current version.
You are responsible for all use of the Services under your account, including by your users, end users, and anyone you give access to. A violation of this AUP is a material breach of the Terms and may result in throttling, suspension, or termination under Sections 12 and 13 of the Terms, with or without notice.
1. Healthy sending statistics
Because deliverability is a shared resource, you must keep your sending within accepted industry norms and any thresholds we communicate. In particular, you must:
- maintain a low hard-bounce rate and promptly suppress addresses and numbers that hard-bounce;
- maintain a low spam-complaint rateand treat any complaint, “mark as spam,” or feedback-loop signal as an immediate, permanent opt-out;
- honor unsubscribe, “STOP,” and do-not-contact requests without undue delay;
- warm up new sending domains, numbers, and volumes gradually rather than sending large spikes from a cold reputation; and
- maintain accurate authentication (e.g., SPF, DKIM, DMARC for email; required carrier or platform registration for SMS and messaging apps).
Sustained high bounce or complaint rates, low engagement, or sending patterns that resemble spam may result in rate limiting or suspension to protect deliverability for SenderKit and other customers.
2. Prohibited sending purposes
You may not use the Services to:
- send unsolicited bulk or commercial messages, or any message for which you cannot demonstrate verifiable, affirmative recipient consent;
- send to purchased, rented, scraped, harvested, or third-party-supplied contact lists;
- conduct phishing, smishing, vishing, business-email-compromise, account-takeover, or credential-harvesting campaigns;
- impersonate any person, brand, or organization, or use deceptive sender names, “from” addresses, subject lines, headers, or unsubscribe links;
- distribute malware, ransomware, spyware, or links to malicious destinations;
- send messages relating to restricted categorieswithout our prior written approval, including high-risk financial services (payday loans, debt collection, cryptocurrency or token solicitations, “get rich quick” schemes, unregistered securities), gambling, cannabis or controlled substances, firearms, tobacco or vaping, adult content, multi-level marketing, sweepstakes or lotteries, and prescription pharmaceuticals; or
- use the Services in any high-risk setting where failure could lead to death, personal injury, or environmental or property damage.
3. Prohibited content
You may not create, send, host, or route content that:
- is unlawful, infringing, defamatory, fraudulent, deceptive, or misleading;
- is threatening, harassing, abusive, hateful, or that promotes violence, self-harm, or discrimination;
- constitutes child sexual abuse material, non-consensual intimate imagery, or the sexual exploitation of any person;
- promotes terrorism, violent extremism, or sanctioned regimes or parties;
- infringes or misappropriates any intellectual-property, privacy, or publicity right; or
- contains sensitive or special-category data (such as PHI subject to HIPAA, payment card data subject to PCI DSS, or biometric or government identifiers) unless you have a separate written agreement with SenderKit permitting it.
4. Permissible recipient lists & consent
You must only message recipients who have given you appropriate, documented consent under applicable law. You must:
- obtain verifiable opt-in consent before sending, and keep auditable records of the consent type, source, and timestamp for each recipient;
- include all legally required content in your messages, including accurate sender identification, a valid postal address where required, a functioning unsubscribe mechanism, and “STOP”/“ HELP” handling for SMS; and
- immediately and permanently honor opt-outs and never re-add a recipient who has unsubscribed without fresh, explicit consent.
You are solely responsible for compliance with all applicable messaging and consumer-protection laws (including CAN-SPAM, TCPA, CASL, GDPR/ePrivacy, and analogous laws), as described in Sections 5 and 7 of the Terms.
5. Prohibited account & platform usage
You may not:
- probe, scan, stress-test, denial-of-service, overload, or otherwise impair the Services or any other party’s systems;
- circumvent or attempt to circumvent rate limits, quotas, billing tiers, plan limits (including the template limit on the Free plan), abuse detection, content filtering, or any safety mechanism;
- reverse engineer, scrape, or harvest data from the Services other than your own, or use the Services to build a competing product;
- share, resell, or sublicense access or API keys except as expressly permitted, or create multiple accounts to evade limits or enforcement; or
- use the Services in a way that harms, or is likely to harm, the deliverability, reputation, security, or business of SenderKit, its providers, or other customers.
6. Reporting & enforcement
To report a suspected violation of this AUP, contact abuse@senderkit.com. We may investigate suspected violations and may monitor, log, and review use of the Services as described in Section 12 of the Terms. You agree to cooperate with abuse investigations, including by providing consent records and list-acquisition documentation on request.
We may take any action we consider appropriate for a violation or suspected violation, including warning, throttling, suspending, or terminating an account, and reporting unlawful activity to authorities, in accordance with Sections 12 and 13 of the Terms.
